Statute of Limitations in Georgia

Every personal injury case involves a number of necessary documents and deadlines, all of which are managed completely by our attorneys. However, the most important deadline for you to understand and keep in mind when seeking compensation for a personal injury lawsuit is the statute of limitations.

In Georgia, the statute of limitations to seek damages for your personal injury is generally two years. This means that you have two years from the date that you sustained your injury in which to file a lawsuit against the party responsible for harming you.

In wrongful death cases, you generally have two years from the date of death in which to file a claim.

After the two-year period, the court will likely dismiss your claim and you will forever lose your ability to seek compensation from the at-fault party. The law does allow some exceptions to this two-year deadline some of which are:

  • If the injured party is under the age of 18, the time limit may be extended until two years after the victim is a legal adult.
  • In the event that the injured party is determined to be legally incompetent to file a lawsuit, the time limit may be tolled until he or she is found competent.
  • In wrongful death cases, if there is no administrator of the estate at the time of death, the statute of limitations may be extended up to five years prior to the beginning of the two-year period.

If the injured party believes that the statute of limitations should be extended for another reason, the court will generally evaluate these arguments on a case by case basis.
